During this time, it is important to show the employee respect while you are having the talk, and you should also let them know that the upcoming adjustments are in no way tied to the employee’s performance. Spread the word about how each and every work, regardless of whether or not it is exempt from overtime pay, contributes to the overall success of the firm.
The fact that management is unaware of the additional hours worked by employees does not change the reality that those employees may be feeling overworked as a result of their schedules. It is essential for managers who are in charge of managing the extra hours of employees to be aware of the times that individuals arrive at work and when they leave to go home again.
Can an employee refuse to work overtime?
- Employees frequently decline to perform the mandatory amount of overtime that is assigned to them.
- An employee can write a letter to their employer in the event that they are denied more work hours for overtime.
- You are not obligated to work overtime unless it is stated in the employment contract that the employee agrees to work overtime at the discretion of management.
- Working overtime is entirely optional and cannot be mandated by the employer.
Do you have to pay non-exempt employees who work overtime?
If a non-exempt employee works overtime without receiving prior consent from a manager or supervisor, and then reports those hours to you, the Fair Labor Standards Act mandates that you pay the employee overtime for the hours that they worked over and beyond their normal schedule. (You do have the ability to reprimand the worker since they broke one of your workplace rules.)
What to do if an employee is working unauthorized overtime?
Have a policy in place that makes it clear you do not want employees to put in unpaid overtime if this is your goal.
